Terms of Use

Welcome to AIVitaPlan! These Terms of Use ("Terms") govern your access to and use of the AIVitaPlan mobile application and related services (collectively, the "Service") provided by Ai Scan Solutions ("we," "us," or "our").

By downloading, installing, or using AIVitaPlan, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using AIVitaPlan, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Ai Scan Solutions.

2. Eligibility

You must be at least 18 years old to use AIVitaPlan. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Service - AIVitaPlan Pro

Subscription Terms

• Auto-Renewal: Your subscription automatically renews each month unless cancelled at least 24 hours before the end of the current period
• Billing: Payment will be charged to your Apple ID account at confirmation of purchase
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period
• Price Changes: We may change subscription prices with at least 30 days notice
• Free Trial: If offered, any unused portion of a free trial period will be forfeited upon subscription purchase

Managing Your Subscription

Subscriptions are managed through your Apple ID account. To manage or cancel:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select AIVitaPlan Pro
5. Tap "Cancel Subscription"

Note: Cancelling your subscription will stop future charges but you'll retain access until the end of your current billing period. No refunds are provided for partial months.

Refund Policy

All subscription purchases are processed through the Apple App Store. Refund requests must be submitted to Apple directly through your Apple ID account. We do not control Apple's refund policy or decisions.

To request a refund from Apple:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find AIVitaPlan Pro and select "Report a Problem"
4. Follow Apple's refund request process

5. Use of Service

Permitted Use

You may use AIVitaPlan for lawful purposes only. You agree to:

• Use the Service for personal, non-commercial purposes
• Provide accurate health and dietary information
• Follow professional medical advice alongside app recommendations
• Respect intellectual property rights

Prohibited Activities

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code, viruses, or malware
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the app
• Use automated systems to access the Service
• Resell, redistribute, or commercially exploit the Service
• Impersonate others or provide false information
• Harass, abuse, or harm other users
• Share your account credentials with others

6. Medical Disclaimer

IMPORTANT: AIVitaPlan is a wellness tool, not a substitute for professional medical advice.

• The Service provides general health and nutrition information only
• Content is for educational and informational purposes
• Always consult qualified healthcare professionals before making health decisions
• Do not disregard professional medical advice based on information from the app
• We do not diagnose, treat, cure, or prevent any disease or condition
• Individual results may vary significantly

Emergency Situations: If you have a medical emergency, call 911 or your local emergency services immediately. Do not rely on AIVitaPlan for emergency medical assistance.

7. Intellectual Property

All content, features, and functionality of AIVitaPlan, including but not limited to:

• Text, graphics, logos, icons, images
• Software, algorithms, and source code
• AI-generated meal plans and recommendations
• Design, layout, and user interface

Are the exclusive property of Ai Scan Solutions and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use AIVitaPlan for personal use only.

8. User Content

You retain ownership of content you submit (health data, meal logs, journal entries). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store and process your content to provide the Service
• Use anonymized, aggregated data for improving the Service
• Generate personalized recommendations based on your input

You represent that you have all necessary rights to submit your content and that it does not violate any laws or third-party rights.

9. Third-Party Services

AIVitaPlan integrates with third-party services including:

• Apple App Store: Payment processing and subscription management
• Firebase/Google Cloud: Data storage and authentication
• RevenueCat: Subscription infrastructure

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers and Limitations of Liability

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties of uninterrupted or error-free service
• Warranties regarding health outcomes or results

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI SCAN SOLUTIONS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Health complications or adverse effects
• Errors or inaccuracies in content or recommendations
• Service interruptions or technical failures

Our total liability shall not exceed the amount you paid for the subscription in the 12 months preceding the claim, or $100, whichever is less.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ai Scan Solutions, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Violation of these Terms
• Violation of any laws or third-party rights
• Content you submit to the Service

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service
• Non-payment of subscription fees
• Any reason at our sole discretion

Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the app settings.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the app
• Updating the "Last Updated" date
• Sending email notifications (for significant changes)

Your continued use of AIVitaPlan after changes constitutes acceptance of the modified Terms. If you do not agree with changes, you must stop using the Service and cancel your subscription.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

1. Informal Negotiation: Contact us at info@aivitaplan.com to resolve the issue informally
2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in Louisiana

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ai Scan Solutions regarding the Service and supersede all prior agreements and understandings.

If you accessed AIVitaPlan through the Apple App Store, you agree that:

• These Terms are between you and Ai Scan Solutions, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for any product warranty claims
• Apple is not responsible for addressing any claims relating to the app
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• Upon acceptance, Apple has the right to enforce these Terms as a third-party beneficiary
